Price of items

The prices applicable to the products are those listed at the time of the order and all include taxes (VAT or similar). The breakdown of these taxes will be provided to you before the order is finalised and formalised. Please note that when you formalise the order, the system will inform you in detail of the total taxable amount of the order, the applicable taxes and the corresponding shipping costs.

Taxes, fees and shipping costs will vary depending on the tax or physical area from where the order is placed or must be shipped, so they may be modified or discounted after selecting the shipping area.

Offers or discount vouchers may have an expiration date after which they are no longer valid.

The prices displayed on the platform may be reviewed and modified at any time as they are subject to changes in the market.

Payment methods

Purchases of products and services may be paid for by credit or debit card in the purchase section or by formalizing the purchase through an electronic POS enabled for this purpose or a secure payment platform/gateway.

Payment by credit or debit card/Paypal/Bizum

If you wish to pay for your purchase by credit/debit card or other payment options available on the website, the payment will be managed through a payment gateway on a secure server.

All your data will be encrypted and will travel over a secure SSL (“Security Socket Layers”) server, which guarantees that neither the owners of this Virtual Store nor third parties will have access to your bank or credit card data.

Once the data has been entered, the bank/Paypal or Bizum will validate your credit card/user data and proceed to charge. At that time, the order will be effective and will be processed and shipped.

Availability

Marocha will do everything possible to satisfy all its customers in the demand for its products.

In the event of unavailability of the product after the order has been placed, the customer will be informed by email of the cancellation of the order.

Shipping

Each of the products that appear on the website with its unit price corresponds to the total price, including taxes and does not include shipping and customs costs.

Shipping and customs costs will be borne by the customer, who will be informed at all times before accepting the order of the exact shipping costs involved. The purchased products will be delivered to the person/company and to the address indicated, within the time indicated for each type of shipment.

The estimated delivery time once it leaves our workshop is 24h to 72h on working days (Monday to Friday) for national shipments, except for the Balearic and Canary Islands, in these territories the delivery time will be 48h to 96h on working days. Deliveries are not made on weekends and holidays from receipt of payment and subject to stock availability.

For those personalized or custom-made items that require manufacturing, such as products made to measure for the client, the estimated delivery period will be between 15 and 20 working days. For those items on demand that, due to their level of complexity or parts, may require a longer period for their manufacturing, the client will be informed of this circumstance, as well as of the new estimated periods for their delivery.

The indicated delivery time is for all items in the store, except for custom-made products, on-demand orders and out-of-stock products. The delivery time for these will depend on the type of product.

If the product is not in stock, the delivery time may be delayed depending on the time it takes our suppliers to replenish it. In this case, Marocha declines all responsibility and will inform the customer of the estimated time of receipt by us.

Orders will not be delivered to PO boxes and we reserve the right to withhold delivery of orders with incorrect addresses. In any case, our customer service department will contact you according to the information provided for any incident or query that may arise in the processing of your order.

Large and especially delicate items will be delivered by door-to-door carrier to ensure delivery in optimal conditions.

Changing the delivery address once the order has been collected by the corresponding transport agency will not be possible unless the customer is responsible for the costs and it is expressly agreed between the parties.

Notes-Customs:

The sale of our products outside the Peninsular territory to countries of the European Union are exempt from VAT (unless the total value of annual sales to said country is below the limit established by its authorities). However, the customs system will apply the corresponding tax charges at each customs office, which will always be the responsibility of the customer and at the time of delivery of the package. In no case can we calculate the amount to be paid in advance, since it depends on the regulatory bodies of each of the destination countries and their customs.

Returns

If for any reason you are not satisfied with your order, you have a period of 14 calendar days, from the date of delivery of the order, to return it (According to Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16).

The first step is to contact us via email at hola@marochahome.com to provide you with the address to which you must return the goods. The products must be sent in the same condition as they were delivered and with their original packaging. It is important that the products are perfectly packaged.

We will send the transport company to the requested address for collection.

Once we have received the items and verified that they meet the conditions in which they were sent, we will proceed to refund the amount. You will receive the refund, minus the return shipping costs, in the same form in which you made the payment and within 10 days from when the returned merchandise is received.

Return shipping costs are the responsibility of the customer (including promotions and offers) except if the product is defective, or by mistake, you received the wrong item, in which case we assume the cost of collection.

Due to the nature of the orders and in accordance with article 45 of Law 7/1996 of 15 January on Retail Trade, there will be no right of return in the case of those goods manufactured according to the client's specifications or that have been clearly made by order of the client or that as a consequence of their state or condition do not meet the appropriate conditions for return.

Customized or made-to-measure products, orders made to order, cannot be exchanged or returned.

The company guarantees that the services covered by the contract will be performed in accordance with the terms set out in the offer. It also undertakes to remedy any defect that is a direct consequence of improper provision of services. For these purposes, the following rules shall be taken into account:

(a) When the effect consists of a defect in the delivered product, the remedy will consist, first and foremost and to the extent possible, in the repair or replacement of the defective product;

(b) When, due to the nature of the service, it is not possible to repair or replace the defective product, the customer will be offered the most favorable technical and economic solution in order to remedy the defect that has occurred;

(c) As a subsidiary, if the correction in accordance with the rules provided in sections (a) and (b) above is not satisfactory, the client shall have the right to demand a reduction in the price or to terminate the contract, with the price paid being returned in the latter case.

The company reserves the right to examine any defects alleged by the customer.

The liability assumed by the company will be limited to the correction in accordance with the terms set out above. The company will not be liable for any incidental damages that may arise from the execution of the services. This category includes, but is not limited to, damages due to loss of data, files, images, information, opportunities or benefits and moral damages.

Furthermore, the company shall not assume any liability for colour differences between the original image and the product supplied, which are caused by a defective quality of the original image file. Claims for reasons of aesthetic taste shall not be considered as defects in the goods.

The guarantees and responsibilities provided for in this clause shall not be applicable when the damage or defect is due to force majeure or a cause attributable to the customer. In any case, the guarantee offered here replaces any other guarantees.

The regime provided for in this clause shall not be applicable to persons acting as consumers in accordance with Spanish legislation, provided that a Judge or Court considers that the limitations provided for herein are contrary to the basic rights of the consumer. The same rule shall apply in cases where fraud or gross negligence is observed in the performance of the services.

As a client, you will be liable to the company and to third parties holding industrial or intellectual property rights as a result of your use of our services. You will also exempt these persons from claims by third parties.

The product must be accompanied by its original packaging and properly sealed.

We recommend checking the order at the time of delivery by the transport agency, and recording it on the delivery note and signing it.

Warranty

Guarantees and after-sales services are governed by Royal Legislative Decree 1/2007 of 16 November, which approves the text of the General Law for the Protection of Consumers and Users. According to this regulation, the seller is obliged to deliver to the consumer and user products that comply with the contract, and is liable to the consumer and user for any lack of conformity.

Modification of the general conditions of sale

Marocha reserves the right to modify the general conditions of sale without prior notice, and may change, delete or add content and services provided through the site, as well as the way in which these appear presented or located on its servers. These changes must be accepted by the User through the Marocha website.

Members/users/customers who do not agree with the changes to the general conditions must notify Marocha. In the event that any of the terms of the general conditions is illegal or unenforceable, it will be null and void and the agreement between the parties will apply, and in the absence thereof, the provisions of the Spanish Civil Code.

Applicable legislation and jurisdiction

Marocha cannot be held liable for any breach of contract in the event of stock shortages or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood or fire. In the event of a dispute, the member will first contact Marocha to obtain an amicable solution.

Access, navigation and/or use of this Website and the contracts for the purchase of products through it shall be governed by Spanish law.

Any controversy, problem or disagreement that arises or is related to the access, navigation and/or use of the Website, or with the interpretation and execution of these Conditions, or with the sales contracts between Marocha and the User, will be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.
